A Supreme Court of Canada (SCC) ruling ordering search engine giant Google to remove the web pages of a company found to be duplicating a technology firm’s products will have a global impact, says Toronto intellectual property lawyer Erika Murray.
“The unprecedented decision will have implications for IP (intellectual property) holders around the world and online intermediaries such as Google,” Murray tells AdvocateDaily.com. “It may impose a higher level of responsibility on third parties in limiting the enablement and facilitation of unlawfully selling the intellectual property of other companies.”
The SCC upheld a British Columbia lower court ruling that ordered Google to remove the Datalink Technology Gateways pages from its global search results as Equustek Solutions Inc. alleged that Datalink was passing off Equustek’s products as its own, says Murray, an associate with Bhole IP Law.
